Please read these Terms of Service ("Terms") carefully before using the Color Season Matcher browser extension (the "Extension"), operated by Essuman Creations, LLC ("we", "our", or "us").
By installing or using the Extension, you agree to be bound by these Terms. If you do not agree, do not install or use it.
The Extension lets you pick any colour visible on your screen using your browser's built-in eyedropper, and tells you that colour's hex code and which colour season it belongs to. If you have set your own season, it also tells you how well the two match.
The Extension is an informational tool, not a professional service. See section 11.
You must be at least 13 years old to use the Extension. It is not directed to children under 13, and we do not knowingly permit them to create an account or collect their personal information. If we learn we hold information belonging to a child under 13, we will delete it.
If you are at least 13 but under the age of majority where you live (a "Permitted Minor"), you may use the Extension only if your parent or legal guardian has read and accepted these Terms on your behalf. Until that has happened, you are not permitted to use it.
A parent or legal guardian who accepts these Terms on behalf of a Permitted Minor agrees to them in their own right, is fully responsible for the Permitted Minor's use of the Extension and compliance with these Terms, and is responsible for any purchase made through the account.
Some features require an account, which you create with an email address and password. You are responsible for keeping your password confidential and for activity under your account. Tell us promptly if you believe your account has been used without your permission.
The free tier includes a limited number of colour analyses per day — currently five — which resets on a rolling 24-hour basis from your first use of the day. The counter is maintained on our servers, with a copy kept in the browser so the Extension can display it quickly.
Paid plans remove that daily limit. We offer recurring plans and a one-time lifetime purchase. The plans available to you, and their prices, are shown before you complete a purchase.
Payments are processed by Stripe. We do not receive or store your card details. Recurring plans renew automatically until cancelled; you can cancel at any time from the account page in the Extension, and cancelling stops future renewals without ending the period you have already paid for.
Where a lifetime purchase has been made, it is tied to your account. If you delete your account and later sign up again with the same email address, we can restore that lifetime access — see the Privacy Policy for how we retain the address for that purpose.
The Extension requests only the permissions it needs, and we describe each one and what it is used for in the Privacy Policy.
The eyedropper uses your browser's own EyeDropper feature. It reads the colour of the single pixel you deliberately choose, only when you activate it. The Extension does not read page content, page text, form data, or browsing history, and it does not run code on the pages you visit.

You may delete your account at any time from the account page in the Extension. Deletion is permanent and we cannot restore a deleted account. What is removed and what is retained is described in the Privacy Policy.
Service email relates to your account — password resets, receipts, subscription notices, and account-deletion confirmation. You receive these because you have an account, and they are not optional while the account exists.
Marketing email is sent only if you have specifically opted in. You may withdraw that consent at any time, in the Extension or through the unsubscribe link in any marketing email. Withdrawing it stops marketing email only and never affects service email.
The Extension — including its design, features, content, and the colour analysis methods behind it — is owned by Essuman Creations, LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of it without our prior written consent.
We may change, suspend, or discontinue any part of the Extension. Because the Extension is distributed through the Chrome Web Store, its availability also depends on Google, and updates may be delivered automatically by the browser.
Colour season results are informational. They are not professional styling advice, personal-image consulting, or advice of any other professional kind, and no professional relationship is created by your use of the Extension.
Colour analysis is inherently subjective. Results also depend on your screen: displays vary in calibration, colour profile, and brightness, and the colour a screen shows is not always the colour of the physical item.
You assume the risk of relying on the Extension, including for any purchase you make after checking a colour with it. We are not a party to any purchase you make from any retailer.
The Extension is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Extension will be uninterrupted or error-free, that results will be accurate in every case, or that it will meet your particular requirements.
To the fullest extent permitted by law, Essuman Creations, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, or the cost of substitute goods or services, arising out of or related to the Extension or these Terms — whether the claim is brought in contract, tort, or otherwise, and even if we have been advised that such damages are possible.
To the fullest extent permitted by law, the total aggregate liability of Essuman Creations, LLC arising out of or related to the Extension or these Terms will not exceed the total amount you have paid to Essuman Creations, LLC.
If you have not paid us anything, our total aggregate liability is zero.
Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of certain damages. Where that is the case, the exclusions and limitations in sections 12, 13, and 14 apply to the maximum extent permitted by applicable law, and nothing in these Terms limits any liability that cannot lawfully be limited.
Before filing any claim against us, you agree to give us written notice at [email protected] describing the dispute and the relief you seek, and to work with us in good faith for at least 30 days to resolve it. This is a condition to bringing a claim.
Any claim arising out of or related to the Extension or these Terms must be brought within one year after the claim arises. A claim brought after that period is permanently barred, except where applicable law does not permit such a limitation.
You agree to indemnify and hold harmless Essuman Creations, LLC and its officers, directors, employees, and agents from any claim, damage, loss, or expense arising from your use of the Extension or your breach of these Terms.
We may suspend or terminate your access at any time if we believe you have breached these Terms or are causing harm to other users, to us, or to third parties. If we terminate your access while you hold a paid plan, and the termination is not due to your breach, we will not charge you for periods after termination.
We may update these Terms from time to time. We will post the updated Terms and change the "Last updated" date above, and where the change is significant we will tell you in the Extension. Continuing to use the Extension after a change takes effect means you accept the revised Terms.
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions.
You and Essuman Creations, LLC agree that any dispute arising out of or related to the Extension or these Terms will be brought exclusively in the state or federal courts located in Arlington County, Virginia, and each of us consents to the personal jurisdiction of those courts.
